Privacy Policy

This Privacy Policy (hereinafter referred to as “the Policy”) provides the terms and conditions related to the handling of member information, including the personal information of members, in the Internet-based service Japanese Chefs Recipes (hereinafter referred to as “the Service”) that is managed, operated and provided by the Association for the Advancement of the Japanese Culinary Art (hereinafter referred to as “the Association”).

1. Member Information to be Collected and the Collection Method

In this Policy, the term “member information” refers to information related to the identification of a member, information on the member’s behavior history in the telecommunication service, and other information that is generated or accumulated in connection with the member through the member’s smart phone, personal computer and other terminals or devices, or in connection with the member’s terminals or devices, and is the information that will be collected by the Association in accordance with this Policy.

  1. Information provided by the member A member shall provide the following information in order to use the Service.
    1. Name
    2. Email address
    3. Date of birth
    4. Address
    5. Telephone Number
    6. Other information that will be entered by the member into the Entry Form prescribed by the Association
  2. Information provided by other services to which connection is allowed by the member in relation to the use of the Service In case the member has permitted a link to social media networks and other external services in the use of the Service, the association will collect the following information from the said external services within the scope allowed by the member.
    1. ID used by the member in said external services
    2. Other information the member agreed to disclose to his contact person based on the privacy settings in said external services
  3. Information collected by the Association in relation to the use of the Service by the member The association may collect information concerning the status of access to the Service and the method in which the Service is used. Such information will include the following.
    1. Information on the terminal or device used
    2. Log information
    3. Cookies and anonymous ID
    4. Information on location

2. Purpose of Use

  1. Member information may, in accordance with the provisions in Item 2-3, be used for purposes other than for the provision of the Service pursuant to Item 2-2.
  2. Member information related to the provision of the Service will be used for the following specific purposes.
    1. Acceptance of registration and verification of identity related to the Service, and provision, maintenance, protection and improvement of the Service
    2. Creation of statistical data related to the use of the Service, and survey, tabulation and analysis of marketing data
    3. Planning for the Service and carrying out and analysis of questionnaires about service improvement
    4. Verification of member when providing guidance to the member about the Service if the member has inquiries
    5. Advertising and promotion (including the sending of direct mails, delivery of emails, and remarketing and retargeting advertising) of products and other services of the Association and third parties, and verification of results or effectiveness of said advertising and promotion
    6. Selection of winners in campaigns and other promotions, and delivery of prizes
    7. Delivery of notifications such as important notices related to the Service, when needed
    8. Prevention and treatment of actions that violate agreements, this Policy and other legal provisions (hereinafter referred to as “Agreements”) of the Association in relation to the Service, and dishonest and illegal acts
    9. Sending of notifications on such matters as changes in the agreements related to the Service
    10. Other purposes associated with the foregoing usage purposes
  3. The following are the purposes of the use of information other than those stipulated in the foregoing Item 2-2, and their corresponding member information.
    1. For the generation of statistical data related to the Service that is processed in a format in which the individual person cannot be identified Information on terminal or device, log, cookies and anonymous ID, and location
    2. For the delivery and presentation of advertisements of the Association and third parties Information on terminal or device, log, cookies and anonymous ID, and location
    3. For use in other marketing campaigns Name, email address, date of birth, and other information entered by the member in the Entry Form prescribed by the Association

3. Acquisition of Consent

The consent of the member will be acquired prior to the collection of the following member information.

  1. Information on the terminal or device used
  2. Information on location

4. External Transmission and Information Collection Module

The Service incorporates the following information collection modules for the purpose of transmitting targeting advertisement using member information. Accordingly, member information will be given to the information collection module provider as follows.

    2. By using the cookies, Google and its partners will show the appropriate advertisement to users based on their access information.

5. Third-Party Information Provision and Sharing

The Association may provide to or share with third parties the information of members under the following circumstances.

  1. The member has given his/her consent The Association may give the information of members, including their personal information, to third parties if the member has given his/her consent.
  2. Sharing with third-party service providers Information on member will be shared with third parties that provide payment processing, data analysis, mail transmission, hosting services and other services on behalf of the Association, and third parties that provide support to the marketing campaign of the Association. The Association will require third-party service providers to preserve the confidentiality of the disclosed information and to use such information only for the provision of services on behalf of the Association.
  3. Sharing with third-party advertisers The Association may share the following information to third-party advertisers: ①specific technical information (e.g., IP address), ②statistical information that cannot specify the individual and ③information related to the use of services that cannot identify the individual. Members will consent to the use of this information by third-party advertisers for the purpose of member trend analysis, web analysis and behavior-targeted advertising.
  4. Legal reasons The Association may need to divulge the personal information of members pursuant to the laws, regulations and legal procedures within and outside of the country of residence of members, or upon the request of relevant public or government institutions.

    The Association may disclose information related to its members if it has deemed it necessary or pertinent to national security, the execution of laws and the realization of public benefits.

    In case it has been rationally determined that the disclosure of information is necessary in the execution of the User Agreement of the Association, in the operation of the Association and the Service, and in the protection of members, then the Association may divulge information related to its members.
  5. Sale or Merger The Association may transfer all or a portion of the personal information obtained by the Association to the relevant parties in the event of reorganization, merger or change of ownership.
  6. In case personal information will be supplied to the Information Collection Module provider in accordance with the provisions of Section 4
  7. In case the disclosure of information is required under the Personal Information Protection Law and other legislations

6. Disclosure of Personal Information

In the event that a member requested for the disclosure of his/her personal information in accordance with the provision of the Personal Information Protection Law, the Association will divulge the information to the member without delay upon verification that the request came from the member himself/herself. (If the requested personal information does not exist, the member will be notified accordingly.)

This provision will not apply if the Association is not obligated to disclose information under the Personal Information Protection Law and other pertinent legislations. A corresponding fee (1,000 USD per request) will be charged in the disclosure of personal information.

7. Correction and Termination of Use of Personal Information

  1. In the event that a member has requested the correction of his/her information in accordance with the Personal Information Protection Law due to the reason that the personal information is not true, or has requested for the termination of use of personal information in accordance with the Personal Information Protection Law due to the reason that the information is handled beyond the previously disclosed purpose or the information was collected by deception or other wrongful means, the Association will conduct the necessary investigation without delay upon verification that the request came from the member himself/herself, rectify or terminate the use of personal information based on the results of its investigation, and notify the member about such matter accordingly. Should the Association decide not to correct or terminate the usage of personal information based on rational reason, the member will be duly notified about its decision.
  2. If the member requested for the deletion of personal information and the Association has determined it necessary to comply with such request, then the Association will erase the personal information upon verification that the request came from the member himself/herself, and notify the member about such matter accordingly.
  3. The provisions under Item 7-2 will not apply if the Association is not obligated to correct or terminate the use of personal information under the Personal Information Protection Law and other pertinent legislations.

9. Procedure for the Amendment of the Privacy Policy

The Association may review the operation status related to the handling of information and modify this Policy as needed toward the continuous improvement of the Service. Should there be changes, members will be notified through the notification function on the Service or through a means deemed appropriate by the Association. However, if the change requires the consent of members under the law, then the consent of the members will be acquired through the Association’s designated method.
