These Terms of Use (hereinafter referred to as "these Terms") stipulate the rights and obligations between AAJ(The Association for the Advancement of the Japanese Culinary Art)and all users of the internet service "Japanese Culinary Research Association Recipe!" (hereinafter referred to as "the Service") managed, operated and provided by the Japan Culinary Research Association (hereinafter referred to as "the Association"). Please be sure to read the entire text of these Terms in advance and fully understand their contents before agreeing to them when registering and using the Service.

Article 1: Definitions

  1. "Our Association" refers to AAJ(The Association for the Advancement of the Japanese Culinary Art)
  2. "This Service" refers to the service called "Japanese Cuisine Research Association Recipe!" provided by our Association (if the name or content of the service is changed for any reason, this includes the service after the change).
  3. "Our Association Website" refers to the website operated by our Association with the domain "recipe-ru.com" (if the domain or content of our Association's website is changed for any reason, this term includes the website after such change).
  4. "Individual Terms, etc." refers to the privacy policy established by the Association, the individual terms and conditions established for individual services provided by the Association within the Service or incidental to the Service, and the contractual provisions related to the Service.
  5. "Service Agreement" refers collectively to these Terms and Conditions, Individual Terms and Conditions, etc., and the agreement for use of the Service concluded between the Association and the Member.
  6. "Member" refers to an individual who has registered as a user of the Service pursuant to Article 3 (Member Registration) and has agreed to abide by these Terms and Conditions.
  7. "Intellectual Property Rights" refers to copyrights, patents, utility model rights, design rights, trademark rights and other intellectual property rights (including the right to acquire such rights or to apply for such rights).

Article 2 Application of Terms of Use

  1. The purpose of these Terms and Conditions is to define the conditions for providing this Service and the rights and obligations between Members and the Association regarding the use of this Service, and they will apply to all relationships related to the use of this Service.
  2. These Terms and Conditions also include Individual Terms and Conditions, etc., and Members shall comply with such Individual Terms and Conditions in the same manner as these Terms and Conditions.
  3. In the event that there is a discrepancy between the provisions of these Terms and Conditions and those of individual terms and conditions, etc., the provisions of the individual terms and conditions, etc. shall take precedence, unless otherwise specified in the individual terms and conditions, etc.

Article 3 Membership Registration

  1. Those who wish to register as members shall agree to abide by these terms and conditions, and after confirming the content of the Service, membership fees, payment methods, etc. displayed on the Association's website, shall apply for membership by providing the Association with the registration information specified by the Association in the manner specified by the Association. In addition, members shall acknowledge in advance that the content of the Service, membership fees, etc. may be subject to change.
  2. The Association shall, in accordance with its standards, determine whether or not to approve the registration of the applicant who has applied for registration under the preceding paragraph, and if the Association approves the registration, shall notify the applicant accordingly. The membership registration shall be considered complete when the Association has given the notification under this paragraph.
  3. When the registration set forth in the preceding paragraph is completed, a service agreement will be established between the Member and the Association, and the Member will be able to use the Service in accordance with these Terms and Conditions.
  4. The Association may refuse registration or re-registration of an applicant for membership if any of the following reasons apply to the applicant. The Association shall not be obligated to disclose the reasons therefor.
    1. If any part of the registration information provided to the Association is false, incorrect or missing.
    2. If the Association determines that the person is an organized crime group, a member of an organized crime group, a right-wing group, an antisocial force, or any other person equivalent thereto (hereinafter referred to as "antisocial forces, etc."), or that the person has some kind of interaction or involvement with antisocial forces, etc., such as cooperating or being involved in the maintenance, operation or management of antisocial forces through funding or other means.
    3. If the Association determines that the applicant for membership is a person who has violated a contract with the Association in the past, or a related person to such a person.
    4. If the applicant for membership has been subject to measures set out in Article 11 (Cancellation of Registration, etc.).
    5. Any other case in which the Association determines that registration is inappropriate.

Article 4: Changes to registered information

  1. If there are any changes to the registered information of a member, the member must promptly notify the Association of the changes in a manner specified by the Association. Until such notification is made, the Association will treat the registered information as if there have been no changes.
  2. If the Association fails to contact a member due to a member notifying it of a change in registered information, the Association shall not be held responsible.

Article 5: User name (ID) and password management

  1. Membership status is personal and exclusive, and Members must properly manage and store their username (ID) and password for the Service at their own responsibility, and must not allow a third party to use them, or lend, transfer, change the name of, buy or sell them.
  2. The member shall bear responsibility for any damages incurred due to insufficient management of the user name (ID) or password, use by a third party, erroneous use, etc., and the Association shall not bear any responsibility whatsoever.
  3. If the Association confirms that the username (ID) and password entered at the time of login match those registered, it will deem that the login is genuine and that the login was made by a registered person.

Article 6: Membership fees, etc.

  1. The content of the Service, membership fees and payment methods as determined by the Association will be displayed on the Association's website in a manner that is recognizable to members.
  2. The Association may revise membership fees due to changes in the content of the Service, etc. In such cases, the Association will notify members in advance by a prescribed method.
  3. If your membership registration is terminated during the service period due to cancellation or other reasons, or if your membership fee payment is canceled or suspended, the Association will not provide refunds on a pro rata basis, etc.
  4. The Association will not refund membership fees once received.
  5. If you cancel your membership payment during the service period or if your membership payment is suspended for any reason, you will no longer be able to view the content of this service.
  6. The Association will not issue receipts for payment of membership fees.

Article 7 Withdrawal

  1. If a member wishes to cancel his/her membership registration, he/she shall apply for withdrawal to the Association in the manner prescribed by the Association. The member agrees in advance and without objection that the cancellation of the membership registration shall be effective immediately and that the member will immediately be unable to use the Service, that the Association will retain and use the member's member information in the manner prescribed in Article 8 even after the cancellation of the membership registration, and that the member will not be relieved of all obligations and liabilities (including but not limited to compensation for damages) under the Service Use Agreement to the Association and other third parties even after the cancellation of the membership registration.
  2. Membership is personal, and the procedure set out in the preceding paragraph will be deemed to have been completed with respect to a member at the time the Association becomes aware of the member's death.
  3. If a member wishes to cancel his/her membership, he/she must complete the cancellation procedures set out by our Association, and unless the cancellation procedures are completed by the day before the date of membership registration, the payment of membership fees will be automatically renewed for the following month or year, and the member agrees to this.
  4. Members must pay the full membership fees for that month and year even if they cancel their membership in the middle of a month or year.
  5. Members acknowledge that if they cease to be members due to withdrawal or other reasons, all information on the Service, including member information, will be deleted and they will no longer be able to confirm the contents. However, the Association is under no obligation to delete such information.
  6. If a Member wishes to register again as a user of the Service after canceling his/her membership, he/she must go through the registration process again. The Member agrees without objection in advance that the data before cancellation will not be carried over after the re-registration process, and that the membership fees paid before cancellation will not be carried over.

Article 8: Handling of Personal Information

  1. The Association's handling of member information shall be governed by the Association's separate Privacy Policy, and Members agree that the Association will handle their member information in accordance with this Privacy Policy.
  2. The Association may use and disclose, at its discretion, the information and data provided by members to the Association as statistical information in a form that does not identify individuals, and members may not object to this.

Article 9: Use of the Internet

  1. Members shall prepare and maintain, at their own expense and responsibility, all communication equipment, software, and other equipment necessary to use the Service, and shall connect to the Service via any telecommunications carrier or provider at their own expense and responsibility.
  2. This service protects personal information using SSL/TLS on all pages where personal information is entered, viewed, or displayed.

Article 10 Ownership of Rights

  1. All intellectual property rights related to this service and our website belong to our association or to those who have granted licenses to use the intellectual property rights to our association. The license to use this service under these terms does not constitute a license to use these intellectual property rights.
  2. Members shall guarantee to the Association that they have the lawful right to post or otherwise transmit information provided to the Association through the Service (hereinafter referred to as "Provided Data") and that the posted Data does not infringe on the rights of any third party.
  3. With regard to the provided data, Members shall grant to the Association a royalty-free, non-exclusive, worldwide, sublicensable and transferable license to use, copy, distribute, create derivative works from, display and execute the data.
  4. Members agree not to exercise their moral rights against the Association or any person who has inherited or been licensed by the Association.

Article 11 Prohibited acts

Members are prohibited from engaging in the following acts in relation to the Service. This also applies even if the website, mobile page, or other information introduced by a Member contains any of the following content.

(1) Any act violating the confidentiality of communications, property, privacy, portrait rights, honor, or credibility of a third party or the Association
(2) Any act that libels, slanders, threatens, or discriminates against a third party or the Association.
(3) Any act that infringes or may infringe the intellectual property rights or any other rights of a third party or the Association.
(4) Copying, public transmission, distribution, adaptation, etc. of information obtained through this service (excluding copying and use for a member's home or corporate use)
(5) Transmitting obscene, cruel, violent or other information that offends third parties
(6) Sending false, chain mail, or large amounts of information, or encouraging the sending of such information
(7) Advertising, publicity, sales activities, election campaigns, solicitation to a particular ideology or religion, or any other similar activities
(8) Any act aimed at accepting donations, contributions, donations, or other monetary or other gifts, regardless of the name, or soliciting investments
(9) Any act of accessing the system of the Service or a system on another network through the Service without authorization
(10) Transmitting harmful computer programs or other harmful content to the Service or to systems on other networks through the Service
(11) Altering or deleting information on the Service without permission
(12) Collecting or storing personal information about members without their consent, attempting to identify individuals, or contacting them outside of the Service
(13) Transferring, assuming, inheriting, leasing, providing as security, or any other act of rights or obligations arising in connection with the Service
(14) Any act that violates laws, regulations, public order and good customs, these Terms and Conditions, individual terms and conditions, or instructions from the Association or the administrator
(15) Any act that interferes with the operation of the Service
(16) Any action that causes disadvantage, damage, or offense to a third party, other members, or the Association
(17) Impersonating a third party
(19) Using the user ID or password of another member of the Service
(20) Making excessive long phone calls or making the same inquiries repeatedly
(21) Any act of forcing the Association to do something without any obligation or reason, or of causing a significant disruption to the Association’s business
(22) Any act that directly or indirectly induces or facilitates any of the acts listed above.
(23) Any other act that the Association deems inappropriate

Article 12 Cancellation of registration, etc.

  1. If a Member falls under any of the following items, the Association may, without prior notice or warning, take one or more of the following measures: delete the provided data, temporarily suspend the Member's use of the Service, cancel the Member's membership registration, terminate the Service Agreement, and/or demand compensation for damages: (1) If the Member violates any provision of these Terms, Individual Terms, etc.
    (2) If it is discovered that the registration information contains false facts.
    (3) If there is no response to an inquiry or other communication requesting a response from the Association for more than 30 days.
    (4) Cases falling under any of the items of Article 3, Paragraph 4.
    (5) If the member's registered PayPal payment service is suspended
    (6) When any of the following conditions apply to a member: the member is subject to compulsory execution, provisional attachment, provisional disposition, or disposition for delinquent taxes; the member is subject to a judgment for the commencement of guardianship assistance or the commencement of assistance; or a petition for the commencement of bankruptcy proceedings or a petition for civil rehabilitation proceedings has been filed against the member.
    (7) Any other case that the Association deems inappropriate.
  2. The Association shall not be liable for any damages incurred by members as a result of any action taken by the Association pursuant to this Article.

Article 13: Changes, interruptions, suspension and termination of the Service

  1. The Association may suspend or discontinue provision of all or part of the Service due to reasons related to the maintenance, operation, or construction of the facilities for the Service, or for the convenience of any telecommunications carrier or provider.
  2. The Association may, at its discretion, change, suspend, or discontinue the provision of all or part of the Service.
  3. The Association shall not be liable for any damages incurred by members as a result of any measures taken by the Association pursuant to this Article.

Article 14 Disclaimer of Warranties and Liability

  1. The Association makes no guarantee that the Service will meet the specific objectives of the Member, that it will have the expected functions, value, accuracy, or usefulness, or that the Member's use of the Service will comply with the laws, regulations, or rules that are applicable to the Member.
  2. The Association shall not be held responsible for the accuracy, legality, morality, copyright permission, etc. of any information obtained by members through this service (including information provided by the Association, information provided by members, links, advertisements, and any other information).
  3. The Association shall not be liable for any interruption or delay in the service due to a system failure, or for any damage or loss of information, web or mobile pages, e-mails, etc. provided by the Association or Members, or for any misdelivery of e-mails.
  4. The information provided by members, web and mobile pages, e-mails, etc. may be subject to technical processing by the system, and the content may be changed. The Association shall not bear any responsibility for the results.
  5. The Association shall not assume any responsibility for any disputes that may arise between members or between a member and a third party regarding the use of this service. Please resolve the dispute between the parties involved.
  6. The Association may provide links to other Internet services on the Service (including banner advertisements). The Association bears no responsibility whatsoever for the use of those Internet services.
  7. The Association may provide a download service for programs, etc. on this service. The Association shall not be held liable for any damages, such as damage to programs, data, etc. on a member's computer or mobile phone, that may occur as a result of running such programs, etc.
  8. The responsibility for the member information registered by a member rests with the member himself/herself, and the Association shall not be liable for the accuracy, reliability, morality, legality, or other aspects of the content of the information registered by the member.
  9. The Association has the authority to view registered member information, posted information, etc. by members. The Association is under no obligation to do so and will not be liable for any damages incurred as a result.
  10. If the Association deems it necessary for operational reasons, it has the right to freely change or delete registered member information, posted information, etc. The Association is not obligated to do so, and will not be held liable for any damages incurred as a result.
  11. The Association is under no obligation to preserve any registered member information or posted information by members. Members shall preserve any necessary information at their own risk.
  12. The Association will take reasonable measures, such as using SSL/TLS and installing firewalls, to prevent damage to members caused by hacking or other unauthorized access. If unauthorized access occurs despite these measures and members suffer damage, the Association will not be held liable.
  13. When using the Service, Members shall take reasonable measures to check for computer viruses, etc. The Association shall not be liable for any damages caused by computer viruses, etc.
  14. Even if the Association is liable, the Association shall only be liable to pay compensation for direct and actual ordinary damages if the occurrence of such damage was due to willful intent or gross negligence.

Article 15: Changes to these Terms and Conditions and the Service

  1. The Association may change these Terms and Conditions and the content of the Service without individual agreement with Members by notifying Members on the Service or in a manner that the Association deems appropriate.
  2. The Terms and Conditions amended as set forth in the preceding paragraph shall take effect from the time they are displayed on the Association's website, etc., unless otherwise specified by the Association.
  3. If a Member uses the Service after these Terms and Conditions and the Service have been changed, or does not complete the cancellation procedure within one month, the Member will be deemed to have agreed to the changes to these Terms and Conditions and the Service.

Article 16 Confidentiality

Members shall be obligated to keep confidential any non-public information disclosed by the Association in connection with the Service and requested to keep such information confidential, unless prior written consent is obtained from the Association.

Article 17: Notification and Contact

Inquiries regarding the Service, other notices or communications from Members to the Association, and notices regarding changes to these Terms and Conditions and other notices or communications from the Association to Members shall be made in the manner specified by the Association.

Article 18 Severability

Even if any provision or part of any provision of these Terms and Conditions is determined to be invalid or unenforceable under the Consumer Contract Act or other laws and regulations, the remaining provisions of these Terms and Conditions and the remaining parts of the provisions that are determined to be invalid or unenforceable shall continue in effect.

Article 19: Governing Law

These Terms (including any individual terms and conditions) and the Service Agreement shall be governed by and construed in accordance with the laws of Japan.

Article 20: Good faith negotiations and exclusive jurisdiction

  1. If a dispute arises between a member and the Association in relation to these Terms and Conditions (including individual terms and conditions) and the service agreement, the dispute shall be resolved through good faith negotiations.
  2. If no resolution is reached despite the consultations set forth in the preceding paragraph, the dispute shall be submitted to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
